Headed by Murray Thornhill, our team understands the value of an approach which may avoid potentially lengthy and expensive litigation, whilst maintaining focus on proactively representing our clients’ best interests.
Litigation is only one method of resolving a dispute. Your solicitor will work with you and advise as to the best way of progressing towards resolution. Some alternatives to litigation are:
Mediation — a process of negotiation whereby an independent person assists the parties to arrive at a solution to a dispute.
Negotiation — discussion or correspondence between the parties directed at settlement without court proceedings. The majority of disputes are settled by negotiation, without a decision by a court.
Conciliation — an expert conciliator actively supervises and generates negotiation between the parties. Most civil courts have some form of compulsory conciliation as part of court procedures.
Arbitration — similar to a court hearing, an arbitrator, who normally has expertise in the subject matter of the dispute, hears evidence and makes a decision on the facts at hand.
